AI Ethics Scandal: Meta Accused of Using AI to Target Workers for Layoffs (2026)

Meta's Use of AI in Layoffs Sparks Legal Battle and Ethical Questions

Meta, the parent company of Facebook, Instagram, and WhatsApp, is facing a lawsuit alleging that it used artificial intelligence tools to unfairly target employees for layoffs. The lawsuit, filed by 26 Meta employees, claims that the company's AI systems disproportionately targeted workers who had taken protected leave or had disabilities, raising concerns about bias and privacy.

The lawsuit highlights a growing issue in the workplace: the use of AI in decision-making processes. As AI becomes more prevalent, employees are increasingly concerned about bias, privacy, and trust. Regulators are also scrutinizing the legality of AI-driven decisions, with several states passing laws to protect workers from AI-related bias.

Meta's AI employee-monitoring program, launched earlier this year, is at the center of the controversy. The program, which captured workers' keystrokes, mouse activity, browser history, and other data, was designed to train AI systems on employee behaviors. However, the lawsuit claims that Meta quietly launched the program without employee buy-in, and that employees received no consent or acknowledgment prompt at all.

The lawsuit also alleges that Meta's AI tools gathered data on employees' performance rankings, productivity, and other metrics, which were not updated when workers were on leave or had disabilities. As a result, employees who took protected leave or had disabilities were disproportionately selected for layoffs, based on scoring that failed to account for their protected leaves or penalized them for exercising their legal rights.

One of the plaintiffs, a scientist on approved pre-birth pregnancy leave, was notified of her layoff just two days before she gave birth. Another plaintiff, an engineer, received a "lowered rating" because of time taken off for an injury. A manager on medical leave was let go 16 days into his time off.

Meta has disputed the allegations, stating that workforce management and organizational decisions were made by people, not AI. However, the lawsuit seeks an independent audit of Meta's AI tools to clarify why the 26 workers were let go. The plaintiffs are also asking the court to allow them to remain anonymous and preserve their employment status while arbitration is pending.

The lawsuit highlights the complex ethical and legal issues surrounding the use of AI in the workplace. As AI becomes more prevalent, it is crucial to ensure that it is used fairly and transparently, and that employees' rights are protected. The outcome of this lawsuit could have significant implications for the future of AI in the workplace.
